In Florida, the Judicial Branch Assumes the Role of the Legislative and Executive Branches
The taxpayers of Florida are really getting cheated in my opinion. In my opinion they're paying taxes for an entire legislature and executive branch that is totally powerless. I always thought that the branches of government were CO-EQUAL. Not in Florida! My opinion is based on this article and the entire frightening story of innocent Terri Schiavo, who has received a death sentence in a cruel and unusual manner. Most people agree that cruel and unusual punishment is reprehensible for criminals. So, why are so many unconcerned when it is about to happen to an INNOCENT person?
I THOUGHT the majority of people elected Governor Jeb Bush to a second term in a democratic process. In my opinion, that election was meaningless as Governor Jeb Bush no longer has any abilities to exercise the Constitutional powers granted to the Executive Branch - if a court does not approve. If this article is correct, I do not see how it is acceptable for laws to allegedly not be followed as are the charges in this article.
Despite the laws being so frequently struck down in courts, it is important to contact your Congressperson and Senators and ask them to vote FOR the Incapacitated Person's Legal Protection Act of 2005. Ask them to co-sponsor the bill. Contact the Office of the Speaker of the House and ask that the bill be fast-tracked. Contact the Senate Majority Leader's Office and ask that the bill be fast-tracked. Read about the House version, H.R. 1151. Read about the Senate version.
I find it very upsetting that absolutely NO court will accept an appeal of one of Judge Greer's decisions. Convicted criminals are granted appeal hearings. Why not an innocent person facing a cruel and unusual death sentence?
What is most troubling is that Judge Greer has denied the Schindler family the ability to administer food and water orally after her husband orders feeding tube removed, beginning the cruel and unusual death sentence. If Terri is really "unresponsive" or "in a coma" as has been claimed, then she should not be able to swallow any food administered orally. One would think that such an action would be welcomed by anyone in favor of removing Terri's feeding tube. Afterall, it would easily prove that the Schindlers are "wrong." So, why not let the experiment happen? What is anyone afraid of? What? Perhaps Terri might swallow the food administered orally and thus bring into question all these claims that she's "in an unresponsive coma"?
So, why does the Florida Legislature continue to propose bills and pass them with the hopes the Governor of Florida will sign them? Why bother going through what is now primarily a symbolic gesture? Since the courts decide anything important, since a single judge or a small panel of judges can wipe out legislation worked on by tens of DEMOCRATICALLY ELECTED legislators whenever they see fit, why bother?
Personally, I have decided to sign the Petition to Impeach Judge Greer. I had heard about this petition for several days prior to signing it. When Judge Greer made his ruling regarding the Florida Department of Children and Families, I finally decided to sign it. I make NO claims about the accuracy of everything in the letter. However, in my opinion, based on the rulings I have read about via the media, I feel he should be impeached. It is up to each person to decide about this themselves. But the petition should be examined at least.
